NOTICE IN TERMS OF THE LOCAL GOVERNMENT: MUNICIPAL FINANCE MANAGEMENT ACT – MUNICIPAL ASSET TRANSFER REGULATION SECTION 34 (1)(3)

NOTICE: 143/2018

Notice is hereby given that the below mentioned application was received and is available for inspection at the office of the Municipal Manager, Cederberg Municipality.

Any objections, with valid reasons, must be submitted in writing to the office of the Municipal Manager within seven (7) days of this notice.

Applicant:                              Citrusdal Wines Pty Ltd (trading as Piekenierskloof Wine   

                                               Company), formerly known as Citrusdal Koöperatiewe 

                                                Wynkelders Beperk.

 

Nature of Application:          The public street closure & the alienation of Abattoir street, Kelder street, a section of Koöperasie street, and a section of Lutz street according to Council Resolution RB.9.10/29-03-2018, Ref.:7/2/R: The plots concerned is:

                                        Citrusdal – The remaining extent of Erf  

                                         1528, Citrusdal, some 4265 m² in extent;

                                         The remaining extent of Erf 2312,   

                                         Citrusdal, some 3479 m² in extent;

                                         Erf 1916, Citrusdal, approximately 39 201m² in extent.

 

Advantages:                          Financial gain:  Portion A-(Abattoir, Kelder, and a section of

                                               Koöperasie Street) R 51000-00

                                               Portion B-(Lutz Street) R 9500-00

                                               4643 m²

                                               Servitudes applies which prohibits the use for extentions.

 

Disadvantages:                      None

                                                

Reasons:

The closure of sections of neighbouring public streets (Abattoir, Koöperasie,

Kelder and Lutz streets) necessitating the transfer of ownership of land and

consolidation thereof with Erf Re/1916. This is due to the encroachment of the

cellar operations and buildings over many years beyond the boundaries for Erf

Re/1916, to the extent that the streets lost their functionality.
